Formula Global Mobility strives to collect, store, process\u00a0and\u00a0distribute Personal Information in a manner consistent with the laws of the countries in\u00a0which it\u00a0does business and has a tradition of maintaining the highest ethical standards in its\u00a0business\u00a0practices. This Privacy Policy (the &#8220;Policy&#8221;) sets forth the privacy principles that Formula\u00a0Global\u00a0Mobility follows regarding the Information transferred to its customers, employees,\u00a0suppliers,\u00a0business partners from anywhere in the world, including the European Economic Area\u00a0(EEA).<\/p>\n<p>The purpose of this policy is to inform data owners (customers, employees, suppliers, business\u00a0partners) and provide us with information about the management of your personal data.\u00a0Formula\u00a0Global Mobility, in the scope of providing its services, needs to collect some personal\u00a0data from its\u00a0Customers.<\/p>\n<p>This Data Protection Policy aims to help customers, employees, suppliers and business partners\u00a0understand what personal information we collect, how and why we use it, who we disclose it to\u00a0and\u00a0how we protect your privacy when using our services or visiting our Platforms.<\/p>\n<p>For the purposes of this Policy, the following definitions shall apply:<\/p>\n<p>&#8220;Personal information&#8221; means any information or set of information that identifies or could be used by or on behalf of Formula Global Mobility to identify an individual. Personal Information does not include coded, anonymous, or publicly available information that was not combined with nonpublic Personal Information. &#8220;Sensitive personal information&#8221; means personal information that reveals race, ethnicity, trade union membership, political opinions, or religious or philosophical beliefs, which relate to health or sex life, or which contain criminal records. In addition, Formula Global Mobility will treat as sensitive personal information any personal information received from a partner where that partner treats and identifies such personal information as sensitive.<\/p>\n<p><strong>1 USE OF PERSONAL DATA<\/strong><\/p>\n<p>The intention is that all customers, employees, suppliers, and business partners become aware\u00a0of the\u00a0general privacy rules and the terms of processing personal data that we collect, in strict\u00a0deference to\u00a0and compliance with applicable legislation in this regard.<\/p>\n<p>Personal data means any information of any nature and regardless of its support, including\u00a0sound\u00a0and image, relating to an identified or identifiable natural person (data subject). Any\u00a0person who\u00a0can be identified directly or indirectly, namely by reference to an identification\u00a0number or to more\u00a0specific elements of his\/her physical, physiological, psychic, economic,\u00a0cultural or social identity,\u00a0shall be considered identifiable.<\/p>\n<p>Formula Global Mobility seeks to respect best practices in security and personal data protection,\u00a0promoting actions and improving systems in order to protect the data that is provided to us by\u00a0our\u00a0customers, employees, suppliers and business partners. Formula Global Mobility will not sell\u00a0or\u00a0share such information with third parties in ways other than those disclosed in this Policy<\/p>\n<p>Formula Global Mobility collects, stores and processes Personal Information of current and past\u00a0employees and job seekers, such as name, contact information, government identifier, financial\u00a0account information, and family information. Formula Global Mobility collects Personal\u00a0Information for employment- related purposes and legitimate business reasons for human\u00a0resources, such as personnel and employee management and evaluation, recruitment, and staff;\u00a0payroll management; absence monitoring; training and development; management planning;\u00a0evaluation and promotion; trade union negotiations; production and publication of company\u00a0address\u00a0books and telephone and e-mail directories; e-mail management and other\u00a0communication systems;\u00a0production of employee identity cards; monitoring the use of company\u00a0resources; information for\u00a0contacting close relatives in an emergency; filling job positions;\u00a0management and operations of its\u00a0benefits and compensation programs; meeting government\u00a0reporting requirements; health, safety\u00a0and security management. Formula Global Mobility does\u00a0not request or collect information about\u00a0political opinions, religion, philosophy, or sexual\u00a0preference. To the extent that Formula Global\u00a0Mobility maintains information about trade union\u00a0membership, health status, race or ethnicity,\u00a0Formula Global Mobility will protect and process\u00a0such information in a manner consistent with this\u00a0Policy and the applicable law.<\/p>\n<p>Formula Global Mobility also collects, stores and processes Personal Information of potential\u00a0customers, consumers, suppliers, consultants and professional advisors, distributors, resellers,\u00a0business partner suppliers and others. Formula Global Mobility collects this Personal Information\u00a0for, among other things, legitimate business reasons, such as processing and fulfillment of\u00a0orders.\u00a0All Personal Information collected by Formula Global Mobility will be used for legitimate\u00a0business\u00a0purposes consistent with this Policy. Formula Global Mobility may process and disclose\u00a0Personal\u00a0Information.<\/p>\n<p><strong>2. PRIVACY PRINCIPLES<\/strong><\/p>\n<p>Formula Global Mobility undertakes to submit the Personal Information covered by this policy\u00a0to\u00a0the following principles:<\/p>\n<p>(1) NOTICE:<br \/>\nWhere Formula Global Mobility collects Personal Information directly from\u00a0individuals,itwillinformyouofthepurposesforwhichFormulaGlobalMobility collects, stores\u00a0and\u00a0processes Personal Information about them, the types of partners to whom Formula Global\u00a0Mobility\u00a0discloses such information and the options and means, if any, that Formula Global\u00a0Mobility offers\u00a0individuals to limit the use and disclosure of their Personal Information. The\u00a0notice will be\u00a0provided in clear language when individuals are requested to provide Personal\u00a0Information to\u00a0Formula Global Mobility, or as soon as possible, and in any event, before Formula\u00a0Global Mobility\u00a0uses the information for a purpose other than that for which it was originally\u00a0collected.<\/p>\n<p>(2) CHOICE:<br \/>\nFormula Global Mobility will offer individuals the opportunity to choose (disable) if\u00a0their Personal\u00a0Information is (a) to be disclosed to partners, or (b) to be used for a purpose other\u00a0than that\u00a0for which they were originally collected or subsequently authorized by the individual.\u00a0For\u00a0Sensitive Personal Information, Formula Global Mobility will give individuals the opportunity\u00a0for\u00a0affirmative and explicit consent (enable) for the disclosure of information to a Partner or the\u00a0use of\u00a0the information fora purpose other than that for which it was originally collected or\u00a0subsequently\u00a0authorized by the individual. Formula Global Mobility will provide individuals with\u00a0reasonable\u00a0mechanisms to opt-in or out should the necessary circumstances arise.<\/p>\n<p>(3) DATA INTEGRITY AND LIMITATION OF PURPOSE:<br \/>\nFormula Global Mobility will use Personal\u00a0Information only in a manner in compliance with the\u00a0purposes for which it was collected or\u00a0subsequently authorized by the individual. Formula Global\u00a0Mobility will take reasonable steps\u00a0to ensure that Personal Information is relevant to its intended\u00a0use, accurate, complete, and\u00a0current.<\/p>\n<p>Formula Global Mobility Data Protection and Privacy Policy &#8211; Review 00 &#8211; 2021<\/p>\n<p>(4) LIABILITY FOR SUBSEQUENT TRANSFER:<br \/>\nFormula Global Mobility uses partners to assist us in\u00a0accomplishing the purposes described in this\u00a0Policy, for example, to support our customers,\u00a0perform technical operations, and store and transmit\u00a0data. Formula Global Mobility will confirm\u00a0that any partner &#8211; to whom it discloses Personal\u00a0Information &#8211; will adequately protect the privacy\u00a0of such Personal Information. Examples of\u00a0appropriate privacy safeguards include: an\u00a0agreement that requires the partner to provide at least\u00a0the same level of protection as required\u00a0by the relevant privacy principles, and the third party is\u00a0subject to applicable data protection\u00a0laws. If Formula Global Mobility becomes aware that a partner\u00a0is using or disclosing Personal\u00a0Information in breach of this Policy, Formula Global Mobility will\u00a0take reasonable actions to\u00a0prevent or discontinue the use or disclosure. Formula Global Mobility\u00a0holds partners &#8211; to whom\u00a0it discloses Personal Information &#8211; accountable for maintaining our\u00a0employees and customers\u00a0trust in the company.<\/p>\n<p>(5) ACCESS AND CORRECTION:<br \/>\nUpon request, Formula Global Mobility will grant individuals\u00a0reasonable access to their Personal\u00a0Information. In addition, Formula Global Mobility shall take\u00a0reasonable steps to allow individuals\u00a0to correct, change or delete information that is shown to\u00a0be inaccurate or incomplete. Any\u00a0employee who wishes to review or update their Personal\u00a0Information may do so by contacting the\u00a0local Human Resources department.<\/p>\n<p>(6) SECURITY:<br \/>\nFormula Global Mobility will take reasonable precautions to protect Personal\u00a0Information under\u00a0its control against loss, misuse and unauthorized access, disclosure, change\u00a0and destruction.\u00a0Formula Global Mobility protects your data in several ways. Physical\u00a0security is designed to\u00a0prevent unauthorized access to the database equipment and hard copies\u00a0of Confidential Personal\u00a0Information. Electronic security measures continuously monitor access\u00a0to our servers and provide\u00a0protection against hackers or other unauthorized access from remote\u00a0locations. This protection\u00a0includes the use of firewalls. Formula Global Mobility limits access to\u00a0Personal Information and\u00a0data to such persons in the Formula Global Mobility organization, or\u00a0as Formula Global Mobility Agents, who have a specific business purpose to maintain and process\u00a0such\u00a0information and personal data. Individuals who have been granted access to Personal\u00a0Information are aware of their responsibilities to protect the security, confidentiality and integrity\u00a0of such\u00a0information and have received training and instruction on how to do so.<\/p>\n<p>(7) APPEAL, EXECUTION AND RESPONSIBILITY:<br \/>\nFormula Global Mobility will conduct compliance\u00a0audits of its relevant privacy practices to verify\u00a0compliance with this Policy and the relevant\u00a0privacy principles. Any employee determined by\u00a0Formula Global Mobility to be in violation of\u00a0this Policy will be subject to penalties up to and\u00a0including termination of employment.<\/p>\n<p>Formula Global Mobility Data Protection and Privacy Policy &#8211; Review 00 &#8211; 2021<\/p>\n<p><strong>3. INTERNET PRIVACY<\/strong><br \/>\nFormula Global Mobility sees the Internet, intranets and the use of other technologies as\u00a0valuable\u00a0tools for communication and interaction with consumers, employees, suppliers,\u00a0business partners\u00a0and others. Formula Global Mobility recognizes the relevance of maintaining\u00a0the privacy of\u00a0Personal Information collected through its websites. Formula Global Mobility &#8216;s\u00a0sole purpose in\u00a0operating its sites is to provide information about products and services to the\u00a0public. Overall,\u00a0visitors can reach Formula Global Mobility through the web without disclosing any\u00a0Personal\u00a0Information. Web visitors may voluntarily choose to provide Personal Information\u00a0through Formula\u00a0Global Mobility &#8216;s websites but are not required to do so. Formula Global\u00a0Mobility collects\u00a0information from site visitors that voluntarily provide Personal Information by\u00a0filling out and\u00a0submitting online questionnaires on comments on the site, requesting\u00a0information about products or\u00a0services or seeking employment. Personal Information\u00a0voluntarily provided by users of the site\u00a0relates to contact information limited to username,\u00a0home and\/or business address, phone numbers\u00a0and email address. Formula Global Mobility\u00a0collects this information so that it can answer\u00a0questions and forward requested information.\u00a0Formula Global Mobility does not sell this\u00a0information.<\/p>\n<p><strong>4. ESCALATION AND MONITORING<\/strong><br \/>\nFormula Global Mobility has an Ethics and Compliance Committee whose objectives are to\u00a0disclose this and other company policies, monitor and provide guidance on compliance. The\u00a0Ethics\u00a0and Compliance Committee also has the authority to process and adjudicate cases of\u00a0violation of\u00a0the Data Privacy and other company policies and to impose disciplinary sanctions\u00a0and penalties.<\/p>\n<p>The Contributor or Representative who becomes aware of any violation of the principles,\u00a0guidelines or standards of this policy shall report the fact through the web site contact channel\u00a0or\u00a0the {Compliance Representative &#8211;\u00a0<a href=\"mailto:quality@formulaglobalmobility.com\">quality@formulaglobalmobility.us<\/a>}. Complaints\u00a0regarding\u00a0violations of the Code of Conduct will be forwarded to the Ethics and Compliance\u00a0Committee.<\/p>\n<p><strong>5.\u00a0CHANGES TO THIS POLICY<\/strong><br \/>\nFormula Global Mobility reserves the right to, at any time, make changes or updates to this<\/p>\n<p>Policy, and these changes are duly updated in our Platforms.
